APUS Launcher User Agreement
1.Preamble
Welcome to use APUS Launcher!
APUS Launcher (hereinafter referred to as “this Product”) is a smart phone user system developed, operated and managed by Beijing Qilin Hesheng Network Technology Co.,ltd. (hereinafter referred to as “APUS”, “we”, “us” or “our"). The APUS Launcher User Agreement (hereinafter referred to as “this Agreement”) is an agreement entered into by and between you and APUS on your registration, login and use (hereinafter referred to as “Use”) of this Product and the relevant services.
In order to better provide you with products and services, we remind you to do carefully read and fully understand this Agreement (especially the terms concerning exemption or limitation of liabilities, the terms concerning right licensing and information use, the terms concerning consent to enabling and use of special individual services, and the terms concerning governing laws and dispute resolution) before you start using this Product. In particular, important contents such as the terms concerning exemption or limitation of liabilities are in bold to arouse your special attention. This Agreement shall constitute a legally binding agreement between you and APUS on this Product and your Use of this Product. Do not use this Product unless you have read and accepted the terms of this Agreement. If you do not agree to this Agreement, we will not be able to serve you normally. Once you use this Product, you are deemed to have read and agreed to be bound by this Agreement and other agreements and rules in connection with this Agreement (including but not limited to “APUS Launcher Privacy Policy”).
This Product is not provided for minors under 16 years of age (or the minimum age required by the laws of the EU member states). Such persons’ claiming to accept the terms of this Agreement shall be null and void. If you are a minor meeting the above conditions, you shall, accompanied by your guardian, read the terms and conditions of this Agreement and use this Product with the approval of your guardian.
2.About APUS Launcher
APUS Launcher is a full-featured smart phone user system launched by APUS and characterized by complete features, small size, high performance and smart usage. APUS Launcher is also a platform for contents and services and to provide users with quality content and services. In addition, APUS Launcher functionally provides a complete set of solutions so as to ensure security and privacy and provide users with a secure and private browsing environment.
APUS Launcher mainly offers the following features:
1)Boost and power saving: In order to facilitate users to experience APUS Launcher more quickly, we provide performance optimization functions to accelerate the operation of user’s mobile phone, and provide power-saving optimization function (Power Saver) to extend the battery life of the mobile phone and make user’s cell phone more power efficient. To ensure the stability of the product, APUS Launcher avoids forcibly writing content to prevent the program from crashing when the storage space is full.
2)Desktop Arrangement: APUS Launcher provides users with a variety of ways to organize and find applications, including placing the Google Play Top applications on desktop, and allowing desktop applications to instantly update status when the state of the application changes (uninstall, upgrade, install); we also provide Smart Folders to intelligently categorize and organize applications into different folders, making users’ desktop more tidy and orderly; we also provide application intelligence rank to place mostly used applications on user’s first two screens, making users to find common applications quickly on the desktop. At the same time, the applications in the folder will be sorted by the frequency of usage, allowing users to find applications quickly in the folder; we will also display all the user’s applications in Allapps, on the interface, users can use the initial letter to find the application quickly. In addition to applications, APUS Launcher provides a widget list to display the widgets corresponding to each application in the mobile phone, and the user can add any widget to the desktop.
3)The necessary system functions: APUS Launcher, as a smart phone user system, will display system time and date in the clock weather widget; APUS Launcher will display the system commonly used shortcut switches in multiple places to facilitate the user to switch state quickly, including switching the automatic brightness switch. , vibration switch, data network switch, mobile phone mode switch, flashlight switch, screen rotation switch, ring switch, bluetooth switch, wifi hot-spot switch, wifi switch and GPS switch; In addition, APUS Launcher will show the number of unread messages and calls, to facilitate the user to obtain unread messages the first time.
4)Desktop beautification: APUS Launcher will recommend beautiful mobile wallpapers for users when the application is initialized. The user can also choose to continue using the original wallpaper of the mobile phone; we will provide a theme & wallpaper shop where users can choose to browse, download and use different styles of themes & wallpaper, and users can upload their own wallpaper through UGC function, as well as browsing and using the wallpaper shared by other users; we also provide more unified and exquisite high-definition application icons for users.
5)Social and content: APUS Launcher provides discovery to find and meet people in the Circle, and can find hot applications and videos used by people nearby to view interesting content. APUS Launcher also provides news and market, providing rich news content, popular applications for users to browse, use and share.
6)Privacy and Security: In order to protect user privacy, APUS Launcher provides applock that lock the user’s privacy applications. Users can only use the password to open the locked application. APUS Launcher provides the function of hide apps, so that users can hide private applications to avoid to be seen by others.
7)Smart Center: APUS Launcher provides an intelligent center that allows users to quickly browse and operate some common functions, including the management of boost and power saving, viewing local weather, the latest pictures, recent contacts, and content of the clipboard and common applications, add and view schedule information, add notes.
8)Web search: Provides users with fast and comprehensive search services, mainly including mainly multi-engine search, search records, search suggestions, voice search, application and game search, quick search, remember search engines and search categories, hot words ranking, download Manage, bookmark several sub-functions. Multi-engine search capabilities support a variety of different search engines to provide users with comprehensive search results. The search record function searches for and uses previously searched words by saving the user’s search history. The search suggestion function supports a variety of different search engines and provides a series of related search suggestion words when the user inputs the keywords. The voice search function can provide users with a quick input method by evoking the system language recognition module. The application and game search function provides users with application and game search results, and can prompt users whether the applications and games in the search results have been installed. The quick search function, can access the latest content in the clipboard, allowing users to quickly search for copied content. Remember search engines and search categories helps users maintain search engines and search categories that were previously set up. Users do not need to repeat settings the next time they search. The hot word rankings feature provides users with the most clicked search content for some countries, so that users can understand the local search hot words. The download management function allows the user to view the download progress of the file when the user downloads the file in the search result page, and quickly finds or deletes the downloaded file, and can automatically start a download task that has not been completed due to a network anomaly or the like. With the bookmark function, the user can bookmark the browsed web pages, and they can open these web pages directly from the bookmarks later.
9)Local search: Provides users with a convenient local search function, supports searching for local applications, contacts, messages, music, videos, calendars, system and APUS settings, and app index. App Search helps users search for applications that have already been installed in the phone. Contact search helps users search for contacts on their mobile phones. SMS search can help users search for historical messages sent and received. Music, video search can help users to search for local storage of audio and video files. Calendar search can help users search for added schedule information. App index search allows you to search for relevant content in some installed apps based on search terms.
10)Pre-activation Service: In order to strictly comply with the laws and policies of the relevant countries or regions, we provide a pre-activation service to know the country or region where the user is located. Users can also manually select the country or region where they are located. We will record the user’s choices on the server.
11)Accounts and related services: APUS Launcher provides email, mobile phone number, Facebook, Google+ and other methods to create and log in your account. After logging in to an account, users can share or upload theme & wallpaper. Users can earn points by completing some tasks. The points are used to redeem virtual prizes (such as advertisements, Google Play Gift Cards, Amazon Gift Cards, etc. or physical goods (dolls, etc.), or directly receive bonus rewards such as red envelopes.
3.Third-party Products and Services
3.1.When using this Product, you may access third-party products or services in the following ways:
1)Embedded Links: Both the search suggestion feature and the webpage translation feature provide users with the corresponding services by embedding the links to the services provided by the corresponding third parties;
2)Jump Links: Both the search feature and the webpage access feature provide users with search and browsing services by jumping links;
3)Embed Third Party Services: In order to support product-related features, we need to embed third-party services to this Product. These third-party services include services for group information statistics and anti-cheating, services for recommendation of personalized advertisements, and services for linked accounts, etc.
4)Using The System Interface: Some functions in the product need to use the system interface to provide services for users. For example, the web browsing function needs to use the API provided by the Android system and the API provided by Android WebView.
3.2.You know and understand that third parties operating these services may require you to provide personal data. APUS will provide these agreements and rules in a conspicuous manner for your review and consent when you plan to use the aforesaid one-way services. Once you start using the aforesaid services, you are deemed to have understood and agreed to be bound by the relevant agreements and rules related to the individual services. APUS specially reminds you to make sure to carefully read user agreements, privacy policies and other related documents of such third parties, provide personal data according to your needs, and properly protect your personal data. If you have any disputes or suffer any losses from use of third-party products or services, you shall settle the disputes or losses with the third parties by yourself, and APUS will not bear any legal responsibility for the aforesaid disputes or losses.
4.Software Licensing and Use
4.1.Scope of Licensing of this Product
APUS grants you a worldwide non-transferable, revocable and non-exclusive license (hereinafter referred to as “this License”) for non-commercial use of this Product. The sole purpose of this License is to enable you to use this Product in the manner permitted by this Agreement. You agree to use this Product only for personal and non-commercial purposes permitted by this Agreement and any applicable laws, regulations or accepted practices and guidelines of the relevant jurisdiction.
All the other rights not granted herein shall be retained by APUS and you shall obtain our written permission prior to the exercise of these rights. APUS’s not exercising any of the aforesaid rights shall not constitute a waiver of that right.
4.2.Obtaining, Installation, Updating and Uninstallation of this Product
You can obtain this Product from APUS’s official website (the domain name is www.apusapps.com), by pre-installation, by downloading from third parties authorized by APUS, or by other means. If you obtain this Product or an installation program having the same name as this Product from a third party not authorized by APUS, APUS will not guarantee the normal use of the product, and the losses you suffer therefrom shall have nothing to do with APUS.
We have developed different application software versions for different terminal devices, and you need to obtain, download and install the appropriate version based on the actual device conditions.
To better enhance user experiences and services, we will irregularly provide updated versions of this Product (including but not limited to software upgrades, replacements and new feature developments), you may update the corresponding version by yourself as needed. After partial or whole updating of this Product, we will remind you in an appropriate manner (including but not limited to system prompts, announcements and in-website messages) and you have the right to choose to accept the updated version; and if you choose not to update, some features of this Product may be limited or cannot be normally used.
If you no longer use this Product, you can uninstall the application software for this Product by yourself. Given that we cannot unilaterally become aware of your uninstallation, your personal data may continue to be stored on our server after you uninstall the software. If you would like us not to retain your personal data after you uninstall this Product, we suggest that you send us a request to delete your personal data before uninstalling this Product. We will respond to your request in accordance with the procedures disclosed in the APUS Launcher Privacy Policy.
5.User Instructions
5.1.Authenticity of Users’ Personal Information
You can use some features of this Product without registering an APUS account. If you want to fully experience the features of this Product, you need to register an account. You confirm and ensure that all the information (including but not limited to third-party accounts, mobile phone numbers, contact addresses and e-mail addresses) submitted in registration is true, accurate, lawful, complete, valid and your own information. If the registered data are changed after account registration, you shall update the registered information in time.
If the information you submit is inaccurate, untrue or unlawful, or APUS has reasonable grounds to suspect that the information is false, untrue or unlawful, APUS shall have the right to refuse to provide you with the relevant features, and you may be unable to use this Product or some features may be limited during use.
5.2.Account and Password Use Rules
Your account shall be used only by you. Without APUS’s written consent, you shall not gift, lend, lease, transfer, sell your account or otherwise permit others to use your account in any way. If APUS finds or has reasonable grounds to believe that the user is not the initial registrant of an account, APUS shall have the right to suspend or terminate the services to the registered account and cancel the account without notifying you.
You should attach great importance to the confidentiality of your account and password, and in no case shall you disclose your account or password to others. You shall bear full legal responsibilities for the activities undertaken in the name of your account, including but not limited to any legal liabilities which may arise from any data modification, speech publication, payments, etc. If you find unauthorized use of your account, please immediately notify APUS.
If you lose your account or forget your password, you can request recovery of your account or password by submitting a timely complaint through APUS’s complaint channels. You understand and acknowledge that APUS’s password recovery mechanism just verifies the consistency of the data on the complaint form with the data recorded in the system, but cannot identify whether a complainant is the real user of the account. APUS specially reminds you to properly keep your account and password. You should log off your account in a secure manner when you finish your use. If your account or password is stolen or lost for your improper keeping, your other faults or Force Majeure, you shall bear the corresponding consequences by yourself.
5.3.Rules on Use of this Product
You shall be responsible for your use of this Product, you shall use this Product within the scope of this Agreement, and you shall not use this Product to engage in the following activities:
1)copy, change, reverse engineer, disassemble, decompile or dismount this Product, attempt to export the source codes of this Product, decode this Product, or otherwise analyze or copy the source codes or conceptions of this Product;
2)interfere, destroy, modify or exert other effects on the normal operation of this Product by using any plug-ins, add-ons, systems or third-party tools without APUS’s authorization or permission;
3)carry out any activities endangering the computer network security by using or targeting at this Product, including but not limited to: use of unauthorized data or access to unauthorized servers/accounts; unauthorized access to the public computer network or other computer systems, and deletion of, modification of or addition to the stored information; unauthorized attempts to detect, scan or test the vulnerabilities of the system or network of this Product, or other acts that disrupt network security; attempts to interfere or destroy the normal operation of the system or network of this Product, intentional spreading of malicious programs or viruses, and other acts that disrupt the normal network information services; falsification of names or partial names of TCP/IP packets;
4)use this Product to infringe upon others’ legitimate rights and interests such as intellectual property rights, portraiture rights, privacy and reputation; or
5)engage in other violations of policies and regulations, public order or good custom, or infringe upon the legitimate rights and interests of other individuals, companies, social groups and organizations.
5.4.Liabilities for Breach
If you breach this Agreement or other service terms, APUS shall have the right to independently make judgments and terminate the services for you without any prior notice. For suspected violations of laws and regulations or suspected offenses, APUS will keep the relevant records, report the suspected violations or offenses to the relevant authorities and cooperate with the relevant authorities in investigation in accordance with the law, and shall have the right to hold you legally responsible.
If you violate this Agreement or other terms and cause any third-party complaints, lawsuits or claims, you shall deal with them and bear all the responsibilities that may arise therefrom. If your violation of laws or breach of this Agreement causes APUS or its affiliates to pay compensation to any third party or be punished by regulatory authorities, APUS shall have the right to require you to compensate it for all the losses.
6.User Privacy Protection
APUS is committed to respecting and protecting your privacy. You can read the APUS Launcher Privacy Policy to learn how we handle your personal data, and the channels provided for you to access and control your personal data.
7.Statement of Rights
7.1.APUS shall have the legal rights with respect to the information that is contained in this Product and protected by intellectual property rights or other laws and regulations, including but not limited to ownership, intellectual property rights (no matter whether such rights have been recorded/registered and no matter whether they exist anywhere in the world) and other relevant interests. Without APUS’s written permission, nobody shall use (including but not limited to monitoring, copying, spreading, displaying, mirroring, uploading or downloading through any robots, spiders and other programs or devices), copy this Product or use this Product for other purposes.
7.2.APUS provides technical support for product development and operation, and shall have all the legally permitted rights to all the data and information generated in development, operation or other stages of this Product.
7.3.When using this Product, you shall in no way cause any damage to the proprietary rights of APUS and/or its licensors, for example, you shall not use trademarks, names or logos in such a way as to confuse the owners or the authorized users of any persons’ trademarks, names or logos.
8.Force Majeure and Limitation of Liabilities
8.1.APUS does not warrant authenticity, accuracy or integrity of any third-party contents, advertisements, publicity materials and any other information (hereinafter collectively referred to as “Third-party Information”) that you have obtained from this Product. If any entity or individual carries out any activities by using the aforesaid “Third-party Information”, you must identify the authenticity and cautiously prevent risks by yourself.
8.2.APUS will make commercially and technically reasonable efforts to ensure the normal operation of the features of this Product, and reasonably and prudently take the necessary measures to protect your information and data security, but we cannot provide a full guarantee. You understand and agree that we shall not be liable for any losses (including but not limited to losses in properties, proceeds, data and other aspects) that you suffer in the following circumstances:
1)this Product cannot normally operate as a result of typhoons, earthquakes, tsunamis, floods, power outages, wars, terrorist attacks, or other Force Majeure events;
2)services for this Product are interrupted or delayed as a result of computer viruses, Trojans, other malicious programs, hacker attacks, telecommunications or network operators’ technical adjustments or failures, system maintenance, or other reasons;
3)services for this Product are interrupted, terminated or delayed as a result of changes in laws and regulations, the orders and rulings of judicial organs and administrative organs, or other reasons; or
4)losses are caused by your use of this Product in violation of rules or your improper operation.
9.Governing Laws and Dispute Settlement
9.1.This Agreement is signed in Beijing, China.
9.2.Conclusion, effectiveness, interpretation, performance, dispute settlement and other matters of or under this Agreement shall be governed by the laws of the People’s Republic of China, without regard to the principle of conflict of laws.
9.3.If you and APUS have any disputes arising from this Agreement, both parties shall negotiate and settle the matter in a friendly manner. If negotiation fails within 90 days from the date of the dispute, you agree to file a lawsuit to the court with jurisdiction over the place where this Agreement is signed.
10.Miscellaneous Terms
10.1.The APUS Launcher Privacy Policy shall be an integral part of this Agreement and APUS shall have the right to amend the terms of this Agreement and/or the relevant terms when necessary. When APUS changes the terms of this Agreement, it will notify you of the changes or additions by e-mail, by letters or in this Product, and you are urged to agree to or reject the amendments to this Agreement, or you can access the latest version of the terms of this Agreement at Privacy Policy.
10.2.If you continue to use this service after the terms of this Agreement are changed, you shall be deemed to have accepted the amended Agreement. If you do not agree to the changes or additions, you have the right to terminate this Agreement and discontinue the use of this Product.
10.3.If some terms of this Agreement are invalid or unenforceable for whatever reason, the remaining provisions shall still be valid and legally binding on you and APUS.
10.4.This Agreement may be provided in Chinese, English and other languages. If there is a conflict between the versions in different languages, the English version shall prevail.

2. About APUS Browser
APUS Browser is a full-featured browser product launched by APUS and characterized by complete features, small size, ease of use, fast webpage browsing and fast downloading. APUS Browser is also a platform for contents and services and to provide users with quality content and services. In addition, APUS Browser functionally provides a complete set of solutions so as to ensure security and privacy and provide users with a secure and private browsing environment.
APUS Browser mainly offers the following features:
Web Browsing: APUS Browser provides users with fast and safe browsing services, including two sub-functions: speed mode and safe browsing. The speed mode function uses cache and image post-load strategies to access web pages more quickly, providing users with a faster browsing experience. The Safe Browsing function can detect whether the webpages visited by users are safe and clearly remind users if users are visiting webpages involving risks;
Browsing History: Save the user’s browsing history when the user visits the webpage, and search and use the webpage that was previously viewed.
Bookmarks: Users can bookmark the web pages they are browsing, and they can open these webpages directly from bookmarks later.
Search: Provides users with fast and comprehensive search services, mainly including multiple engine searches, search records, search suggestions, voice search, and quick search. Multi-engine search capabilities support a variety of different search engines to provide users with comprehensive search results. The search record function searches for and uses previously searched words by saving the user’s search history. The search suggestion function supports a variety of different search engines and provides a series of related search suggestion words when the user inputs the keywords. The voice search function can provide users with a quick input method by evoking the system language recognition module. The quick search function, can access the latest content in the clipboard, allowing users to quickly search for copied content.
Privacy Tags: Users can create privacy tags, and use this Product together with privacy tags, so that the browsing history and the search history will not be recorded and the cookies information will be erased when the privacy tags are closed;
Download Function: APUS Browser enables multi-threaded and multi-tasked downloading, so that users can download files faster;
Pre-activation Service: In order to strictly comply with the laws and policies of the relevant countries or regions, we provide a pre-activation service to know the country or region where the user is located. Users can also manually select the country or region where they are located. We will record the user’s choices on the server.
In order to provide free and high quality app services, we shall publish advertisements during your usage of our products. In the meantime, you still have the right to choose personalized or non-personalized ads. If you opt out seeing personalized ads, you’ll still see ads, but they’ll be less relevant.
3. Third-party Products and Services
3.1. When using this Product, you may access third-party products or services in the following ways:

5. User Instructions
5.1. Authenticity of Users’ Personal Information
You can use some features of this Product without registering an APUS account. If you want to fully experience the features of this Product, you need to register an account. You confirm and ensure that all the information (including but not limited to third-party accounts, mobile phone numbers, contact addresses and e-mail addresses) submitted in registration is true, accurate, lawful, complete, valid and your own information. If the registered data are changed after account registration, you shall update the registered information in time.
If the information you submit is inaccurate, untrue or unlawful, or APUS has reasonable grounds to suspect that the information is false, untrue or unlawful, APUS shall have the right to refuse to provide you with the relevant features, and you may be unable to use this Product or some features may be limited during use.
5.2. Account and Password Use Rules
Your account shall be used only by you. Without APUS’s written consent, you shall not gift, lend, lease, transfer, sell your account or otherwise permit others to use your account in any way. If APUS finds or has reasonable grounds to believe that the user is not the initial registrant of an account, APUS shall have the right to suspend or terminate the services to the registered account and cancel the account without notifying you.
You should attach great importance to the confidentiality of your account and password, and in no case shall you disclose your account or password to others. You shall bear full legal responsibilities for the activities undertaken in the name of your account, including but not limited to any legal liabilities which may arise from any data modification, speech publication, payments, etc. If you find unauthorized use of your account, please immediately notify APUS.
If you lose your account or forget your password, you can request recovery of your account or password by submitting a timely complaint through APUS’s complaint channels. You understand and acknowledge that APUS’s password recovery mechanism just verifies the consistency of the data on the complaint form with the data recorded in the system, but cannot identify whether a complainant is the real user of the account. APUS specially reminds you to properly keep your account and password. You should log off your account in a secure manner when you finish your use. If your account or password is stolen or lost for your improper keeping, your other faults or Force Majeure, you shall bear the corresponding consequences by yourself.
5.3. Rules on Use of this Product
You shall be responsible for your use of this Product, you shall use this Product within the scope of this Agreement, and you shall not use this Product to engage in the following activities:
copy, change, reverse engineer, disassemble, decompile or dismount this Product, attempt to export the source codes of this Product, decode this Product, or otherwise analyze or copy the source codes or conceptions of this Product;
interfere, destroy, modify or exert other effects on the normal operation of this Product by using any plug-ins, add-ons, systems or third-party tools without APUS’s authorization or permission;
carry out any activities endangering the computer network security by using or targeting at this Product, including but not limited to: use of unauthorized data or access to unauthorized servers/accounts; unauthorized access to the public computer network or other computer systems, and deletion of, modification of or addition to the stored information; unauthorized attempts to detect, scan or test the vulnerabilities of the system or network of this Product, or other acts that disrupt network security; attempts to interfere or destroy the normal operation of the system or network of this Product, intentional spreading of malicious programs or viruses, and other acts that disrupt the normal network information services; falsification of names or partial names of TCP/IP packets;
use this Product to infringe upon others’ legitimate rights and interests such as intellectual property rights, portraiture rights, privacy and reputation;
engage in other violations of policies and regulations, public order or good custom, or infringe upon the legitimate rights and interests of other individuals, companies, social groups and organizations.
5.4. Liabilities for Breach
If you breach this Agreement or other service terms, APUS shall have the right to independently make judgments and terminate the services for you without any prior notice. For suspected violations of laws and regulations or suspected offenses, APUS will keep the relevant records, report the suspected violations or offenses to the relevant authorities and cooperate with the relevant authorities in investigation in accordance with the law, and shall have the right to hold you legally responsible.
If you violate this Agreement or other terms and cause any third-party complaints, lawsuits or claims, you shall deal with them and bear all the responsibilities that may arise therefrom. If your violation of laws or breach of this Agreement causes APUS or its affiliates to pay compensation to any third party or be punished by regulatory authorities, APUS shall have the right to require you to compensate it for all the losses.
6. User Privacy Protection
APUS is committed to respecting and protecting your privacy. You can read the APUS Browser Privacy Policy to learn how we handle your personal data, and the channels provided for you to access and control your personal data.7. Statement of Rights
7.1. APUS shall have the legal rights with respect to the information that is contained in this Product and protected by intellectual property rights or other laws and regulations, including but not limited to ownership, intellectual property rights (no matter whether such rights have been recorded/registered and no matter whether they exist anywhere in the world) and other relevant interests. Without APUS’s written permission, nobody shall use (including but not limited to monitoring, copying, spreading, displaying, mirroring, uploading or downloading through any robots, spiders and other programs or devices), copy this Product or use this Product for other purposes.
7.2. APUS provides technical support for product development and operation, and shall have all the legally permitted rights to all the data and information generated in development, operation or other stages of this Product.
7.3. When using this Product, you shall in no way cause any damage to the proprietary rights of APUS and/or its licensors, for example, you shall not use trademarks, names or logos in such a way as to confuse the owners or the authorized users of any persons’ trademarks, names or logos.
8. Force Majeure and Limitation of Liabilities
8.1. APUS does not warrant authenticity, accuracy or integrity of any third-party contents, advertisements, publicity materials and any other information (hereinafter collectively referred to as "Third-party Information") that you have obtained from this Product. If any entity or individual carries out any activities by using the aforesaid "Third-party Information", you must identify the authenticity and cautiously prevent risks by yourself.
8.2. APUS will make commercially and technically reasonable efforts to ensure the normal operation of the features of this Product, and reasonably and prudently take the necessary measures to protect your information and data security, but we cannot provide a full guarantee. You understand and agree that we shall not be liable for any losses (including but not limited to losses in properties, proceeds, data and other aspects) that you suffer in the following circumstances:
1) this Product cannot normally operate as a result of typhoons, earthquakes, tsunamis, floods, power outages, wars, terrorist attacks, or other Force Majeure events;
2) services for this Product are interrupted or delayed as a result of computer viruses, Trojans, other malicious programs, hacker attacks, telecommunications or network operators’ technical adjustments or failures, system maintenance, or other reasons;
3) services for this Product are interrupted, terminated or delayed as a result of changes in laws and regulations, the orders and rulings of judicial organs and administrative organs, or other reasons;
4) losses are caused by your use of this Product in violation of rules or your improper operation.
9. Governing Laws and Dispute Settlement
9.1. This Agreement is signed in Beijing City, People’s Republic of China
9.2. Conclusion, effectiveness, interpretation, performance, dispute settlement and other matters of or under this Agreement shall be governed by the laws of the People’s Republic of China, without regard to the principle of conflict of laws.
9.3. All disputes arising from or in connection with this Agreement shall be submitted to Beijing International Arbitration Center for arbitration in accordance with its rules of arbitration. The arbitral award is final and binding upon both parties, and the seat of the arbitration shall be Beijing.
10. Miscellaneous Terms
10.1. The APUS Browser Privacy Policy shall be an integral part of this Agreement and APUS shall have the right to amend the terms of this Agreement and/or the relevant terms when necessary. When APUS changes the terms of this Agreement, it will notify you of the changes or additions by e-mail, by letters or in this Product, and you are urged to agree to or reject the amendments to this Agreement, or you can access the latest version of the terms of this Agreement at APUS Browser Privacy Policy
10.2. If you continue to use this service after the terms of this Agreement are changed, you shall be deemed to have accepted the amended Agreement. If you do not agree to the changes or additions, you have the right to terminate this Agreement and discontinue the use of this Product.
10.3. If some terms of this Agreement are invalid or unenforceable for whatever reason, the remaining provisions shall still be valid and legally binding on you and APUS.
10.4. This Agreement may be provided in Chinese, English and other languages. If there is a conflict between the versions in different languages, the English version shall prevail.

1.Preamble
Welcome to use APUS MsgCenter!
MsgCenter (hereinafter referred to as “this Product”) is a smart phone information management software developed, operated and managed by Beijing Qilin Hesheng Network Technology Co.,ltd. Limited (“APUS” “We” or “us”)。The MsgCenter User Agreement (hereinafter referred to as “this Agreement”) is an agreement entered into by and between you and APUS on your registration, login and use (hereinafter referred to as “Use”) of this Product and the relevant services
In order to better provide you with products and services, we remind you to do carefully read and fully understand this Agreement (especially the terms concerning exemption or limitation of liabilities, the terms concerning right licensing and information use, the terms concerning consent to enabling and use of special individual services, and the terms concerning governing laws and dispute resolution) before you start using this Product.
In particular, important contents such as the terms concerning exemption or limitation of liabilities are in bold to arouse your special attention. This Agreement shall constitute a legally binding agreement between you and APUS on this Product and your Use of this Product. Do not use this Product unless you have read and accepted the terms of this Agreement. If you do not agree to this Agreement, we will not be able to serve you normally. Once you use this Product, you are deemed to have read and agreed to be bound by this Agreement and other agreements and rules in connection with this Agreement (including but not limited to APUS MsgCenter Privacy Policy").
This Product is not provided for minors under 16 years of age (or the minimum age required by the laws of the EU member states). Such persons’ claiming to accept the terms of this Agreement shall be null and void. If you are a minor meeting the above conditions, you shall, accompanied by your guardian, read the terms and conditions of this Agreement and use this Product with the approval of your guardian.
2.About APUS MsgCenter
APUS MsgCenter is a smart phone information management software launched by APUS to provide you with message reminding, quick reply, message grouping, search and other functions to help you efficiently manage SMS and third party messages.
APUS MsgCenter mainly contains the following functions:
1)SMS function: the message center can directly view the received message notification and send, reply, and send short message to the contact. We provide you with SMS related functions, such as the text message in the form of a list in the message center page, send or reply message at the message center, put the contact message session top to the top Display and so on.
2)Third-party message management: we provide the functions of third party message aggregation, message grouping and notification bar management. For example, we display messages in a list in the form of a list of third party social applications that you receive, and you can divide the same message into a set of displays.
3)Contact management: we display a contact in the form of a list in the message center, and you can jump into the chat interface with the contact by dragging a contact to the desired open icon.。
4)Call recording and dialing: displaying all the call records in the mobile phone in the form of lists, and you can dial the phone directly in the message center.
5)Message reminding: when a message center detection receives a new unread message from a message, a phone, a mail, a third-party application, a reminder bubble on the desktop will display the corresponding application icon to prompt you to have new messages. Prevent users from missing important messages.
6)Search: the message center provides you with the function of searching all information content in the application, including summary information, third-party messages, contacts, and call records.
7)Integral mall: through the registered account, you can obtain integral rewards (including signing in, inviting friends) in the product through the completion of the task (including signing and inviting friends) for the exchange of virtual prizes and physical goods.
3.Third-party Products and Services
3.1.When using this Product, you may access third-party products or services in the following ways:
1)Embed Third Party Services: In order to support product-related features, we need to embed third-party services to this Product. These third-party services include services for group information statistics and anti-cheating, services for recommendation of personalized advertisements, and services for linked accounts, etc.
2)Using The System Interface: Some functions in the product need to use the system interface to provide services for users. For example, the web browsing function needs to use the API provided by the Android system and the API provided by Android WebView.
3.2.You know and understand that third parties operating these services may require you to provide personal data. APUS will provide these agreements and rules in a conspicuous manner for your review and consent when you plan to use the aforesaid one-way services. Once you start using the aforesaid services, you are deemed to have understood and agreed to be bound by the relevant agreements and rules related to the individual services. APUS specially reminds you to make sure to carefully read user agreements, privacy policies and other related documents of such third parties, provide personal data according to your needs, and properly protect your personal data. If you have any disputes or suffer any losses from use of third-party products or services, you shall settle the disputes or losses with the third parties by yourself, and APUS will not bear any legal responsibility for the aforesaid disputes or losses.
4.Software Licensing and Use
4.1.Scope of Licensing of this Product
APUS grants you a worldwide non-transferable, revocable and non-exclusive license (hereinafter referred to as “this License”) for non-commercial use of this Product. The sole purpose of this License is to enable you to use this Product in the manner permitted by this Agreement. You agree to use this Product only for personal and non-commercial purposes permitted by this Agreement and any applicable laws, regulations or accepted practices and guidelines of the relevant jurisdiction.
All the other rights not granted herein shall be retained by APUS and you shall obtain our written permission prior to the exercise of these rights. APUS’s not exercising any of the aforesaid rights shall not constitute a waiver of that right.
4.2.Obtaining, Installation, Updating and Uninstallation of this Product
You can be on the APUS official website or through by pre-installation, by downloading from third parties authorized by APUS, or by other means. If you obtain this Product or an installation program having the same name as this Product from a third party not authorized by APUS, APUS will not guarantee the normal use of the product, and the losses you suffer therefrom shall have nothing to do with APUS.
We have developed different application software versions for different terminal devices, and you need to obtain, download and install the appropriate version based on the actual device conditions.
To better enhance user experiences and services, we will irregularly provide updated versions of this Product (including but not limited to software upgrades, replacements and new feature developments), you may update the corresponding version by yourself as needed. After partial or whole updating of this Product, we will remind you in an appropriate manner (including but not limited to system prompts, announcements and in-website messages) and you have the right to choose to accept the updated version; and if you choose not to update, some features of this Product may be limited or cannot be normally used.
If you no longer use this Product, you can uninstall the application software for this Product by yourself. Given that we cannot unilaterally become aware of your uninstallation, your personal data may continue to be stored on our server after you uninstall the software. If you would like us not to retain your personal data after you uninstall this Product, we suggest that you send us a request to delete your personal data before uninstalling this Product. We will respond to your request in accordance with the procedures disclosed in the APUS MsgCenter Privacy Policy.
5.User Instructions
5.1.Authenticity of Users’ Personal Information

9.3.Any dispute arising from this agreement between you and APUS shall be settled in a friendly manner. No consequence is negotiated within 90 days from the date of the dispute, and you agree to bring a lawsuit to the court with jurisdiction over this agreement.
10.Miscellaneous Terms
10.1.The APUS MsgCenter Privacy Policy shall be an integral part of this Agreement and APUS shall have the right to amend the terms of this Agreement and/or the relevant terms when necessary. When APUS changes the terms of this Agreement, it will notify you of the changes or additions by e-mail, by letters or in this Product, and you are urged to agree to or reject the amendments to this Agreement, or you can access the latest version of the terms of this Agreement at Privacy Policy
10.2.If you continue to use this service after the terms of this Agreement are changed, you shall be deemed to have accepted the amended Agreement. If you do not agree to the changes or additions, you have the right to terminate this Agreement and discontinue the use of this Product.

1)Embedded Links: Both the search suggestion feature and the webpage translation feature provide users with the corresponding services by embedding the links to the services provided by the corresponding third parties;
2)Jump Links: Both the search feature and the webpage access feature provide users with search and browsing services by jumping links;
3)Embed Third Party Services: In order to support product-related features, we need to embed third-party services to this Product. These third-party services include services for group information statistics and anti-cheating, services for recommendation of personalized advertisements, and services for linked accounts, etc.
4)Using The System Interface: Some functions in the product need to use the system interface to provide services for users. For example, the web browsing function needs to use the API provided by the Android system and the API provided by Android WebView.
3.2. You know and understand that third parties operating these services may require you to provide personal data. APUS will provide these agreements and rules in a conspicuous manner for your review and consent when you plan to use the aforesaid one-way services. Once you start using the aforesaid services, you are deemed to have understood and agreed to be bound by the relevant agreements and rules related to the individual services. APUS specially reminds you to make sure to carefully read user agreements, privacy policies and other related documents of such third parties, provide personal data according to your needs, and properly protect your personal data. If you have any disputes or suffer any losses from use of third-party products or services, you shall settle the disputes or losses with the third parties by yourself, and APUS will not bear any legal responsibility for the aforesaid disputes or losses.
4. Software Licensing and Use
4.1. Scope of Licensing of this Product
APUS grants you a worldwide non-transferable, revocable and non-exclusive license (hereinafter referred to as “this License”) for non-commercial use of this Product. The sole purpose of this License is to enable you to use this Product in the manner permitted by this Agreement. You agree to use this Product only for personal and non-commercial purposes permitted by this Agreement and any applicable laws, regulations or accepted practices and guidelines of the relevant jurisdiction.
All the other rights not granted herein shall be retained by APUS and you shall obtain our written permission prior to the exercise of these rights. APUS’s not exercising any of the aforesaid rights shall not constitute a waiver of that right.
4.2. Obtaining, Installation, Updating and Uninstallation of this Product
You can obtain this Product from APUS’s official website (the domain name is apusapps.com), by pre-installation, by downloading from third parties authorized by APUS, or by other means. If you obtain this Product or an installation program having the same name as this Product from a third party not authorized by APUS, APUS will not guarantee the normal use of the product, and the losses you suffer therefrom shall have nothing to do with APUS.
We have developed different application software versions for different terminal devices, and you need to obtain, download and install the appropriate version based on the actual device conditions.
To better enhance user experiences and services, we will irregularly provide updated versions of this Product (including but not limited to software upgrades, replacements and new feature developments), you may update the corresponding version by yourself as needed. After partial or whole updating of this Product, we will remind you in an appropriate manner (including but not limited to system prompts, announcements and in-website messages) and you have the right to choose to accept the updated version; and if you choose not to update, some features of this Product may be limited or cannot be normally used.
If you no longer use this Product, you can uninstall the application software for this Product by yourself. Given that we cannot unilaterally become aware of your uninstallation, your personal data may continue to be stored on our server after you uninstall the software. If you would like us not to retain your personal data after you uninstall this Product, we suggest that you send us a request to delete your personal data before uninstalling this Product. We will respond to your request in accordance with the procedures disclosed in the APUS Booster+ Policy.
5. User Instructions
5.1. Authenticity of Users’ Personal Information
You can use some features of this Product without registering an APUS account. If you want to fully experience the features of this Product, you need to register an account. You confirm and ensure that all the information (including but not limited to third-party accounts, mobile phone numbers, contact addresses and e-mail addresses) submitted in registration is true, accurate, lawful, complete, valid and your own information. If the registered data are changed after account registration, you shall update the registered information in time.
If the information you submit is inaccurate, untrue or unlawful, or APUS has reasonable grounds to suspect that the information is false, untrue or unlawful, APUS shall have the right to refuse to provide you with the relevant features, and you may be unable to use this Product or some features may be limited during use.
5.2. Account and Password Use Rules
Your account shall be used only by you. Without APUS’s written consent, you shall not gift, lend, lease, transfer, sell your account or otherwise permit others to use your account in any way. If APUS finds or has reasonable grounds to believe that the user is not the initial registrant of an account, APUS shall have the right to suspend or terminate the services to the registered account and cancel the account without notifying you.
You should attach great importance to the confidentiality of your account and password, and in no case shall you disclose your account or password to others. You shall bear full legal responsibilities for the activities undertaken in the name of your account, including but not limited to any legal liabilities which may arise from any data modification, speech publication, payments, etc. If you find unauthorized use of your account, please immediately notify APUS.
If you lose your account or forget your password, you can request recovery of your account or password by submitting a timely complaint through APUS’s complaint channels. You understand and acknowledge that APUS’s password recovery mechanism just verifies the consistency of the data on the complaint form with the data recorded in the system, but cannot identify whether a complainant is the real user of the account. APUS specially reminds you to properly keep your account and password. You should log off your account in a secure manner when you finish your use. If your account or password is stolen or lost for your improper keeping, your other faults or Force Majeure, you shall bear the corresponding consequences by yourself.
5.3. Rules on Use of this Product
You shall be responsible for your use of this Product, you shall use this Product within the scope of this Agreement, and you shall not use this Product to engage in the following activities:
copy, change, reverse engineer, disassemble, decompile or dismount this Product, attempt to export the source codes of this Product, decode this Product, or otherwise analyze or copy the source codes or conceptions of this Product;
interfere, destroy, modify or exert other effects on the normal operation of this Product by using any plug-ins, add-ons, systems or third-party tools without APUS’s authorization or permission;
carry out any activities endangering the computer network security by using or targeting at this Product, including but not limited to: use of unauthorized data or access to unauthorized servers/accounts; unauthorized access to the public computer network or other computer systems, and deletion of, modification of or addition to the stored information; unauthorized attempts to detect, scan or test the vulnerabilities of the system or network of this Product, or other acts that disrupt network security; attempts to interfere or destroy the normal operation of the system or network of this Product, intentional spreading of malicious programs or viruses, and other acts that disrupt the normal network information services; falsification of names or partial names of TCP/IP packets;
use this Product to infringe upon others’ legitimate rights and interests such as intellectual property rights, portraiture rights, privacy and reputation; or
engage in other violations of policies and regulations, public order or good custom, or infringe upon the legitimate rights and interests of other individuals, companies, social groups and organizations.
5.4. Liabilities for Breach
If you breach this Agreement or other service terms, APUS shall have the right to independently make judgments and terminate the services for you without any prior notice. For suspected violations of laws and regulations or suspected offenses, APUS will keep the relevant records, report the suspected violations or offenses to the relevant authorities and cooperate with the relevant authorities in investigation in accordance with the law, and shall have the right to hold you legally responsible.
If you violate this Agreement or other terms and cause any third-party complaints, lawsuits or claims, you shall deal with them and bear all the responsibilities that may arise therefrom. If your violation of laws or breach of this Agreement causes APUS or its affiliates to pay compensation to any third party or be punished by regulatory authorities, APUS shall have the right to require you to compensate it for all the losses.
6. User Privacy Protection
APUS is committed to respecting and protecting your privacy. You can read the APUS Booster+ Privacy Policy to learn how we handle your personal data, and the channels provided for you to access and control your personal data.
7.Statement of Rights
7.1. APUS shall have the legal rights with respect to the information that is contained in this Product and protected by intellectual property rights or other laws and regulations, including but not limited to ownership, intellectual property rights (no matter whether such rights have been recorded/registered and no matter whether they exist anywhere in the world) and other relevant interests. Without APUS’s written permission, nobody shall use (including but not limited to monitoring, copying, spreading, displaying, mirroring, uploading or downloading through any robots, spiders and other programs or devices), copy this Product or use this Product for other purposes.
7.2. APUS provides technical support for product development and operation, and shall have all the legally permitted rights to all the data and information generated in development, operation or other stages of this Product.
7.3. When using this Product, you shall in no way cause any damage to the proprietary rights of APUS and/or its licensors, for example, you shall not use trademarks, names or logos in such a way as to confuse the owners or the authorized users of any persons’ trademarks, names or logos.
8. Force Majeure and Limitation of Liabilities
8.1. APUS does not warrant authenticity, accuracy or integrity of any third-party contents, advertisements, publicity materials and any other information (hereinafter collectively referred to as “Third-party Information”) that you have obtained from this Product. If any entity or individual carries out any activities by using the aforesaid “Third-party Information”, you must identify the authenticity and cautiously prevent risks by yourself.
8.2. APUS will make commercially and technically reasonable efforts to ensure the normal operation of the features of this Product, and reasonably and prudently take the necessary measures to protect your information and data security, but we cannot provide a full guarantee. You understand and agree that we shall not be liable for any losses (including but not limited to losses in properties, proceeds, data and other aspects) that you suffer in the following circumstances:
1) this Product cannot normally operate as a result of typhoons, earthquakes, tsunamis, floods, power outages, wars, terrorist attacks, or other Force Majeure events;
2) services for this Product are interrupted or delayed as a result of computer viruses, Trojans, other malicious programs, hacker attacks, telecommunications or network operators’ technical adjustments or failures, system maintenance, or other reasons;
3) services for this Product are interrupted, terminated or delayed as a result of changes in laws and regulations, the orders and rulings of judicial organs and administrative organs, or other reasons; or
4) losses are caused by your use of this Product in violation of rules or your improper operation.
9. Governing Laws and Dispute Settlement
9.1.This Agreement is signed in Beijing City, People’s Republic of China
9.2.Conclusion, effectiveness, interpretation, performance, dispute settlement and other matters of or under this Agreement shall be governed by the laws of the People’s Republic of China, without regard to the principle of conflict of laws.
9.3.All disputes arising from or in connection with this Agreement shall be submitted to Beijing International Arbitration Center for arbitration in accordance with its rules of arbitration. The arbitral award is final and binding upon both parties, and the seat of the arbitration shall be Beijing.
10.Miscellaneous Terms
10.1. The APUS Booster+ Privacy Policy shall be an integral part of this Agreement and APUS shall have the right to amend the terms of this Agreement and/or the relevant terms when necessary. When APUS changes the terms of this Agreement, it will notify you of the changes or additions by e-mail, by letters or in this Product, and you are urged to agree to or reject the amendments to this Agreement, or you can access the latest version of the terms of this Agreement at

10.2. If you continue to use this service after the terms of this Agreement are changed, you shall be deemed to have accepted the amended Agreement. If you do not agree to the changes or additions, you have the right to terminate this Agreement and discontinue the use of this Product.
10.3. If some terms of this Agreement are invalid or unenforceable for whatever reason, the remaining provisions shall still be valid and legally binding on you and APUS.
10.4. This Agreement may be provided in Chinese, English and other languages. If there is a conflict between the versions in different languages, the English version shall prevail.

Welcome to use APUS Flashlight!
APUS Flashlight (hereinafter referred to as “this Product”) is a flashlight product developed, operated and managed by Qilin Hesheng Network Technology Co., Ltd. (hereinafter referred to as “APUS”, “we”, “us” or “our"). The APUS Flashlight User Agreement (hereinafter referred to as “this Agreement”) is an agreement entered into by and between you and APUS on your registration, login and use (hereinafter referred to as “Use”) of this Product and the relevant services.
In order to better provide you with products and services, we remind you to do carefully read and fully understand this Agreement (especially the terms concerning exemption or limitation of liabilities, the terms concerning right licensing and information use, the terms concerning consent to enabling and use of special individual services, and the terms concerning governing laws and dispute resolution) before you start using this Product. In particular, important contents such as the terms concerning exemption or limitation of liabilities are in bold to arouse your special attention. This Agreement shall constitute a legally binding agreement between you and APUS on this Product and your Use of this Product. Do not use this Product unless you have read and accepted the terms of this Agreement. Pre-activation Service: In order to strictly comply with the laws and policies of the relevant countries or regions, we provide a pre-activation service to know the country or region where the user is located. Users can also manually select the country or region where they are located. We will record the user’s choices on the server;
In order to provide free and high quality app services, we shall publish advertisements during your usage of our products. In the meantime, you still have the right to choose personalized or non-personalized ads. If you opt out seeing personalized ads, you’ll still see ads, but they’ll be less relevant.
3.Third-party Products and Services
3.1. When using this Product, you may access third-party products or services in the following ways:
Embedded link: The anti-virus function of the product needs to provide service to users through virus engines provided by the third party.
Jump Links: Both the search feature and the webpage access feature provide users with search and browsing services by jumping links;
Embed Third Party Services: In order to support product-related features, we need to embed third-party services to this Product. These third-party services include services for group information statistics and anti-cheating, services for recommendation of personalized advertisements, and services for linked accounts, etc.
Using The System Interface: Some functions in the product need to use the system interface to provide services for users. For example, the web browsing function needs to use the API provided by the Android system and the API provided by Android WebView.
3.2. You know and understand that third parties operating these services may require you to provide personal data. APUS will provide these agreements and rules in a conspicuous manner for your review and consent when you plan to use the aforesaid one-way services. Once you start using the aforesaid services, you are deemed to have understood and agreed to be bound by the relevant agreements and rules related to the individual services. APUS specially reminds you to make sure to carefully read user agreements, privacy policies and other related documents of such third parties, provide personal data according to your needs, and properly protect your personal data. If you have any disputes or suffer any losses from use of third-party products or services, you shall settle the disputes or losses with the third parties by yourself, and APUS will not bear any legal responsibility for the aforesaid disputes or losses.
4.Software Licensing and Use
4.1 Scope of Licensing of this Product
APUS grants you a worldwide non-transferable, revocable and non-exclusive license (hereinafter referred to as “this License”) for non-commercial use of this Product. The sole purpose of this License is to enable you to use this Product in the manner permitted by this Agreement. You agree to use this Product only for personal and non-commercial purposes permitted by this Agreement and any applicable laws, regulations or accepted practices and guidelines of the relevant jurisdiction.
All the other rights not granted herein shall be retained by APUS and you shall obtain our written permission prior to the exercise of these rights. APUS’s not exercising any of the aforesaid rights shall not constitute a waiver of that right.
4.2. Obtaining, Installation, Updating and Uninstallation of this Product
You can obtain this Product from APUS’s official website (the domain name is apusapps.com), by pre-installation, by downloading from third parties authorized by APUS, or by other means. If you obtain this Product or an installation program having the same name as this Product from a third party not authorized by APUS, APUS will not guarantee the normal use of the product, and the losses you suffer therefrom shall have nothing to do with APUS.
We have developed different application software versions for different terminal devices, and you need to obtain, download and install the appropriate version based on the actual device conditions.
To better enhance user experiences and services, we will irregularly provide updated versions of this Product (including but not limited to software upgrades, replacements and new feature developments), you may update the corresponding version by yourself as needed. After partial or whole updating of this Product, we will remind you in an appropriate manner (including but not limited to system prompts, announcements and in-website messages) and you have the right to choose to accept the updated version; and if you choose not to update, some features of this Product may be limited or cannot be normally used.
If you no longer use this Product, you can uninstall the application software for this Product by yourself. Given that we cannot unilaterally become aware of your uninstallation, your personal data may continue to be stored on our server after you uninstall the software. If you would like us not to retain your personal data after you uninstall this Product, we suggest that you send us a request to delete your personal data before uninstalling this Product. We will respond to your request in accordance with the procedures disclosed in the APUS Security Policy.
5.User Instructions
5.1.Authenticity of Users’ Personal Information
You can use some features of this Product without registering an APUS account. If you want to fully experience the features of this Product, you need to register an account. You confirm and ensure that all the information (including but not limited to third-party accounts, mobile phone numbers, contact addresses and e-mail addresses) submitted in registration is true, accurate, lawful, complete, valid and your own information. If the registered data are changed after account registration, you shall update the registered information in time.
If the information you submit is inaccurate, untrue or unlawful, or APUS has reasonable grounds to suspect that the information is false, untrue or unlawful, APUS shall have the right to refuse to provide you with the relevant features, and you may be unable to use this Product or some features may be limited during use.
5.2.Account and Password Use Rules
**Your account shall be used only by you. Without APUS’s written consent, you shall not gift, lend, lease, transfer, sell your account or otherwise permit others to use your account in any way. If APUS finds or has reasonable grounds to believe that the user is not the initial registrant of an account, APUS shall have the right to suspend or terminate the services to the registered account and cancel the account without notifying you. **
You should attach great importance to the confidentiality of your account and password, and in no case shall you disclose your account or password to others. You shall bear full legal responsibilities for the activities undertaken in the name of your account, including but not limited to any legal liabilities which may arise from any data modification, speech publication, payments, etc. If you find unauthorized use of your account, please immediately notify APUS.
If you lose your account or forget your password, you can request recovery of your account or password by submitting a timely complaint through APUS’s complaint channels. You understand and acknowledge that APUS’s password recovery mechanism just verifies the consistency of the data on the complaint form with the data recorded in the system, but cannot identify whether a complainant is the real user of the account. APUS specially reminds you to properly keep your account and password. You should log off your account in a secure manner when you finish your use. If your account or password is stolen or lost for your improper keeping, your other faults or Force Majeure, you shall bear the corresponding consequences by yourself.
5.3.Rules on Use of this Product
You shall be responsible for your use of this Product, you shall use this Product within the scope of this Agreement, and you shall not use this Product to engage in the following activities:
copy, change, reverse engineer, disassemble, decompile or dismount this Product, attempt to export the source codes of this Product, decode this Product, or otherwise analyze or copy the source codes or conceptions of this Product; or
interfere, destroy, modify or exert other effects on the normal operation of this Product by using any plug-ins, add-ons, systems or third-party tools without APUS’s authorization or permission;
carry out any activities endangering the computer network security by using or targeting at this Product, including but not limited to: use of unauthorized data or access to unauthorized servers/accounts; unauthorized access to the public computer network or other computer systems, and deletion of, modification of or addition to the stored information; unauthorized attempts to detect, scan or test the vulnerabilities of the system or network of this Product, or other acts that disrupt network security; attempts to interfere or destroy the normal operation of the system or network of this Product, intentional spreading of malicious programs or viruses, and other acts that disrupt the normal network information services; falsification of names or partial names of TCP/IP packets;
use this Product to infringe upon others’ legitimate rights and interests such as intellectual property rights, portraiture rights, privacy and reputation;
engage in other violations of policies and regulations, public order or good custom, or infringe upon the legitimate rights and interests of other individuals, companies, social groups and organizations.
5.4. Liabilities for Breach
If you breach this Agreement or other service terms, APUS shall have the right to independently make judgments and terminate the services for you without any prior notice. For suspected violations of laws and regulations or suspected offenses, APUS will keep the relevant records, report the suspected violations or offenses to the relevant authorities and cooperate with the relevant authorities in investigation in accordance with the law, and shall have the right to hold you legally responsible.
If you violate this Agreement or other terms and cause any third-party complaints, lawsuits or claims, you shall deal with them and bear all the responsibilities that may arise therefrom. If your violation of laws or breach of this Agreement causes APUS or its affiliates to pay compensation to any third party or be punished by regulatory authorities, APUS shall have the right to require you to compensate it for all the losses.
6.User Privacy Protection
APUS is committed to respecting and protecting your privacy. You can read the APUS Security Privacy Policy to learn how we handle your personal data, and the channels provided for you to access and control your personal data.
7. Statement of Rights
7.1. APUS shall have the legal rights with respect to the information that is contained in this Product and protected by intellectual property rights or other laws and regulations, including but not limited to ownership, intellectual property rights (no matter whether such rights have been recorded/registered and no matter whether they exist anywhere in the world) and other relevant interests. Without APUS’s written permission, nobody shall use (including but not limited to monitoring, copying, spreading, displaying, mirroring, uploading or downloading through any robots, spiders and other programs or devices), copy this Product or use this Product for other purposes.
7.2. APUS provides technical support for product development and operation, and shall have all the legally permitted rights to all the data and information generated in development, operation or other stages of this Product.
7.3. When using this Product, you shall in no way cause any damage to the proprietary rights of APUS and/or its licensors, for example, you shall not use trademarks, names or logos in such a way as to confuse the owners or the authorized users of any persons’ trademarks, names or logos.
8.Force Majeure and Limitation of Liabilities
8.1. APUS does not warrant authenticity, accuracy or integrity of any third-party contents, advertisements, publicity materials and any other information (hereinafter collectively referred to as “Third-party Information”) that you have obtained from this Product. If any entity or individual carries out any activities by using the aforesaid “Third-party Information”, you must identify the authenticity and cautiously prevent risks by yourself.
8.2. APUS will make commercially and technically reasonable efforts to ensure the normal operation of the features of this Product, and reasonably and prudently take the necessary measures to protect your information and data security, but we cannot provide a full guarantee. You understand and agree that we shall not be liable for any losses (including but not limited to losses in properties, proceeds, data and other aspects) that you suffer in the following circumstances:
1) this Product cannot normally operate as a result of typhoons, earthquakes, tsunamis, floods, power outages, wars, terrorist attacks, or other Force Majeure events;
2) services for this Product are interrupted or delayed as a result of computer viruses, Trojans, other malicious programs, hacker attacks, telecommunications or network operators’ technical adjustments or failures, system maintenance, or other reasons;
3) services for this Product are interrupted, terminated or delayed as a result of changes in laws and regulations, the orders and rulings of judicial organs and administrative organs, or other reasons; or
4) losses are caused by your use of this Product in violation of rules or your improper operation.
9.Governing Laws and Dispute Settlement
9.1.This Agreement is signed in Beijing City, People’s Republic of China
9.2.Conclusion, effectiveness, interpretation, performance, dispute settlement and other matters of or under this Agreement shall be governed by the laws of the People’s Republic of China, without regard to the principle of conflict of laws.
9.3.All disputes arising from or in connection with this Agreement shall be submitted to Beijing International Arbitration Center for arbitration in accordance with its rules of arbitration. The arbitral award is final and binding upon both parties, and the seat of the arbitration shall be Beijing.
10.Miscellaneous Terms
10.1. The APUS Security Privacy Policy shall be an integral part of this Agreement and APUS shall have the right to amend the terms of this Agreement and/or the relevant terms when necessary. When APUS changes the terms of this Agreement, it will notify you of the changes or additions by e-mail, by letters or in this Product, and you are urged to agree to or reject the amendments to this Agreement, or you can access the latest version of the terms of this Agreement at Privace Notice
10.2. If you continue to use this service after the terms of this Agreement are changed, you shall be deemed to have accepted the amended Agreement. If you do not agree to the changes or additions, you have the right to terminate this Agreement and discontinue the use of this Product.
10.3. If some terms of this Agreement are invalid or unenforceable for whatever reason, the remaining provisions shall still be valid and legally binding on you and APUS.
10.4. This Agreement may be provided in Chinese, English and other languages. If there is a conflict between the versions in different languages, the English version shall prevail.
